Professional Association of Lawyers “Jonikaitis, Janusaitis LINKLEX”, legal entity code 303219283 (hereinafter referred to as the “Law Firm”), respecting your right to privacy and protection of your Personal Data, undertakes to process the Personal Data obtained by you when you use the Law Firm-managed website linklex.lt, or when you are one of our clients or other data subjects, in accordance with the requirements of the legislation and the legal obligations defined in the present Privacy Policy. The Law Firm collects and processes Personal Data acting as a data controller.
For the purpose of providing legal services – the Law Firm collects and processes Personal Data that you (or acting through a representative) provide yourself, that the Law Firm receives from clients or their representatives, and that the Law Firm receives/collects in the course of providing legal services. For this purpose of the processing of Personal Data is the conclusion and proper performance of a contract for the provision of legal services and the proper provision of legal services on the basis thereof. For this purpose, the Law Firm processes your and/or your representative’s name, surname, date of birth, personal identification number, address, telephone number, email address and other contact details, data concerning financial situation, image, voice, health data, and other Personal Data obtained from the data subjects or from other entities (e.g., registries, courts of law), including public sources, for the purposes of the proper provision of legal services. The Law Firm shall store the Personal Data processed by it in accordance with the mandatory retention periods laid down by law, as well as in the light of the retention period, in order to be able to exercise the rights and fulfil the obligations arising out of contractual or statutory obligations.
For the purpose of exercising the attorney’s statutory rights and duties – for the purposes of carrying out the activities of attorneys at law provided for in the Law on the Bar of the Republic of Lithuania and the provision of legal services, the Law Firm processes Personal Data of you, your representative, clients and other data subjects (e.g. a client’s debtor, the other party to a litigation, etc.), obtained from the persons themselves, their representatives, or from other persons/authorities (e.g. courts, pre-trial investigation agencies, registers, etc.). The purpose of the processing of Personal Data is to ensure that the provision of legal services complies with the requirements of the law, to fulfill legal obligations and to exercise the professional rights and obligations of the attorney at law. For this purpose, the Law Firm shall process the name, surname, date of birth, personal identification number, address, telephone number, e-mail address and other contact data, data on financial situation, image, voice, health data and other Personal Data obtained from you, other data subjects or other persons, including public sources, including for the purpose of the proper exercise of the lawyer’s rights and duties. The Law Firm shall store the Personal Data processed by it in accordance with the mandatory retention periods laid down by law, taking into account the period of time necessary for the exercise of the rights and obligations arising from contracts or legal acts.
For the purpose of contractual relations not involving the provision of legal services – the Law Firm collects and processes Personal Data in order to enter into and properly perform contracts, other than contracts for the provision of legal services, with you, other data subjects or legal entities. For this purpose, the Law Firm processes the name, surname, date of birth, personal identification number and contact details of data subjects, including representatives of legal persons.
For direct marketing purposes – in order to inform you, your clients or other data subjects about the legal services provided by the Law Firm, the events (e.g. trainings) organised by the Law Firm and the latest developments in the field of law, the Law Firm shall process the Personal Data received from the data subject, such as the e-mail address, mobile phone number, only after they have been received from the data subject and on the basis of the data subject’s consent.
For anti-money laundering purposes – in order to comply with a legal obligation, the Law Firm processes Personal Data in connection with certain financial transactions, whether in cash or otherwise, which may be related to money laundering, by processing for this purpose the name, surname, other personally identifiable Personal Data, bank account and payment details, the origin and source of the funds, and any other information required for this purpose. Personal Data processed for this purpose shall be processed for a maximum period of 10 years from the date of receipt and, in the event of a longer retention period provided for by law, until the end of that period.
For payment accounting purposes – the Law Firm shall process Personal Data, such as name, surname, date of birth, bank account number, personal identification number and contact details, for the purpose of issuing, receiving, storing and otherwise processing accounting documents (e.g. invoices) in order to comply with the requirements of the law. Personal Data processed for this purpose shall be kept for the statutory retention periods.
For the purpose of selecting staff – to get to know the person seeking employment in the Law Firm, his or her experience, profession, qualifications and abilities, and to assess his or her suitability for a job or other equivalent post in the Law Firm. For this purpose, the Law Firm shall process the following Personal Data provided to the Law Firm by you or, with your consent, by third parties: name, surname, date of birth, postal address, telephone number, e-mail address, information on education, qualifications. Personal Data processed for this purpose shall be stored for a maximum period of 1 year after receipt.
For the development and management of websites – in order to improve and develop the website operated by the Law Firm, and to respond to your requests made through this website, the Law Firm processes Personal Data collected from data subjects using this website, such as browser type, visitor’s IP address, browsing history, email address, etc. This Personal Data is obtained by the Law Firm from data subjects through the use of websites operated by the Law Firm and/or third parties, including through the use of cookies or similar technologies. Personal Data processed for this purpose shall be stored for a maximum period of 1 year after receipt.
Only with your explicit consent the Law Firm may process and use your Personal Data (email address, mobile phone number) for the purpose of direct marketing in order to provide you with newsletters/announcements about the legal services provided by the Law Firm, the latest developments in the field of law, and organised events. The Law Firm may process the email address of existing clients, their representatives on the basis of legitimate interest, unless these persons do not consent to such processing by concluding a contract or express their opposition by contacting the Law Firm. If the Law Firm asks for your consent for the use of your Personal Data for direct marketing purposes, it will do so in a separate request.
Personal Data processed for direct marketing purposes is processed and stored until you withdraw your consent or unsubscribe from the newsletter. You may withdraw your consent to the processing of Personal Data for direct marketing purposes at any time by e-mail info@linklex.lt.
The Law Firm shall ensure that Personal Data processed by it will not be disclosed to third parties without lawful justification or used for purposes other than those for which they were collected. The Law Firm reserves the right to disclose Personal Data to third parties if it is obliged to do so by law (e.g. pre-trial investigation authorities, etc.).
The Law Firm may transfer your Personal Data to third parties (e.g. website operators, payment institutions, etc.) for the purpose of assisting the Law Firm in the performance of its activities and/or direct marketing. Personal Data will only be transferred to third parties after it has been ascertained and ensured that it is only processed in accordance with the instructions given by the Law Firm and the applicable legal requirements for the protection of Personal Data. Third parties may not use this Personal Data for purposes other than to provide services to the Law Firm.
If Personal Data are to be transferred to third countries (outside the European Economic Area), the Law Firm requires partners and service providers to process Personal Data by taking certain security measures and in accordance with the requirements of the General Data Protection Regulation, and to comply with standard contractual clauses, approved by the European Commission, which ensure the protection of Personal Data.
